General Terms and Conditions – Minimonkey
These General Terms and Conditions apply to all offers, orders, and agreements concluded with Minimonkey, established in Amsterdam, the Netherlands, and registered with the Chamber of Commerce under number 34243852.
By placing an order, the customer agrees to these Terms and Conditions.
1. Orders and Acceptance
1.1 An order constitutes a binding agreement once it has been confirmed by Minimonkey via email.
1.2 Minimonkey reserves the right to refuse or cancel any order in cases of:
- suspected fraud
- incorrect or incomplete customer information
- payment issues
- unauthorized transactions
1.3 Minimonkey reserves the right to request additional verification prior to shipment.
2. Payment and Retention of Title
2.1 All orders must be paid in full prior to shipment.
2.2 Products remain the property of Minimonkey until full payment has been received.
2.3 In the event of a payment reversal, chargeback, dispute, or unauthorized transaction claim, Minimonkey reserves the right to:
- refuse future orders
- recover outstanding amounts
- initiate collection or legal procedures
3. Delivery and Proof of Delivery
3.1 Orders are shipped to the delivery address provided by the customer.
3.2 The customer is solely responsible for providing a correct and complete delivery address.
3.3 Once the shipment has been handed over to the carrier, the risk of loss, delay, or damage transfers to the customer, unless otherwise required by mandatory law.
3.4 Shipping confirmation, tracking information, and delivery confirmation issued by the carrier shall constitute binding proof of shipment and delivery.
3.5 If tracking information indicates that the order has been delivered to the provided address, the order shall be considered successfully delivered.
3.6 A claim of non-receipt after confirmed delivery does not automatically entitle the customer to a refund.
4. International Shipping and Customs Duties
4.1 International shipments are made under Delivered At Place (DAP) terms.
4.2 The customer acts as the importer of record and is fully responsible for:
- import duties
- VAT
- taxes
- customs clearance fees
- disbursement or administrative fees charged by the carrier
4.3 These charges are not included in the product price or shipping costs.
4.4 Refusal to pay customs duties or related charges does not entitle the customer to a refund of shipping costs or other incurred expenses.
4.5 If a shipment is refused or returned due to unpaid customs charges, Minimonkey reserves the right to deduct all shipping costs, return shipping costs, customs charges, and administrative fees from any refund.
5. Returns and Refunds
5.1 Returns are accepted only if:
- the product is unused
- the product is in original condition
- the product is returned in its original packaging
5.2 Returns must be notified to Minimonkey in advance via email.
5.3 Refunds will only be processed after receipt and inspection of the returned product.
5.4 Shipping costs, customs duties, and administrative fees are non-refundable.
5.5 Refunds will be issued exclusively via the original payment method.
6. Fraud Prevention and Chargebacks
6.1 By placing an order, the customer confirms that:
- the order was placed knowingly and voluntarily
- the provided information is accurate
- the payment was authorized and lawful
6.2 If a customer initiates a chargeback or payment dispute without first contacting Minimonkey, Minimonkey reserves the right to:
- submit evidence of order confirmation, shipment, delivery, and communication to the payment provider
- refuse future orders
- recover any damages incurred
6.3 Evidence provided in the event of a dispute may include, but is not limited to:
- order confirmation
- IP address
- payment confirmation
- tracking information
- delivery confirmation
- email correspondence
6.4 Fraudulent chargebacks may result in legal action.
7. Warranty
7.1 Minimonkey warrants its products against manufacturing defects for twelve (12) months from the date of purchase.
7.2 This warranty applies only to the original purchaser.
7.3 This warranty does not cover damage caused by:

misuse

improper use

normal wear and tear
-
unauthorized modifications

failure to follow instructions
7.4 Minimonkey’s obligation is limited to repair or replacement of the defective product.
8. Limitation of Liability
7.1 Minimonkey shall not be liable for:
- delays caused by carriers
- customs delays
- import duties or related charges
- indirect or consequential damages
7.2 The maximum liability of Minimonkey shall be limited to the purchase price of the product..
9. Fraud Prevention and Chargebacks
9.1 Minimonkey reserves the right to refuse orders suspected of fraud.
9.2 Fraudulent chargebacks or payment disputes may result in refusal of future orders.
9.3 Minimonkey reserves the right to provide order, shipping, delivery confirmation, and communication records to payment providers in the event of disputes.
10. Privacy
10.1 Minimonkey respects customer privacy.
10.2 Personal information is used solely for order processing, payment, and delivery.
10.3 Personal data will not be sold or shared with third parties except where necessary for payment processing and delivery.
11. Force Majeure
Minimonkey is not liable for delays or failure to perform due to circumstances beyond its reasonable control, including but not limited to:

natural disasters

strikes

technical failures
12. Intellectual Property
All website content, images, branding, and materials are the intellectual property of Minimonkey and may not be copied or used without written permission.
13. Governing Law
All agreements and disputes are governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands.
